1. Agreement to These Terms

These Terms of Use govern your access to and use of MindPave, including our website, courses, learning content, quizzes, account features, and related services. By accessing or using MindPave, you agree to these Terms. If you do not agree, do not use the service.

2. Eligibility and Accounts

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials. You are responsible for activity that occurs under your account.

MindPave is not directed to children under 13, and you may not use the service if you are under 13.

3. Educational Purpose Only

MindPave provides educational and informational content. Nothing on the platform should be treated as legal, financial, medical, tax, or other professional advice. You are responsible for how you interpret and apply any information provided through the service.

4. Purchases, Billing, and Subscriptions

Some features may require payment. If you purchase access to a course or subscription, you agree to pay all applicable fees disclosed at checkout.

If MindPave offers recurring subscriptions, you authorize recurring charges using your selected payment method until cancellation. Subscription terms, billing intervals, and pricing will be disclosed at checkout.

You may cancel future recurring charges at any time, but cancellation does not automatically entitle you to a refund for payments already processed unless stated otherwise in our Refund Policy.

5. Refunds

Refund eligibility is governed by our Refund Policy. By making a purchase, you agree to that policy.

6. Intellectual Property

MindPave and its content, including course materials, text, music, videos, graphics, branding, logos, software, and platform design, are owned by MindPave or its licensors and are protected by intellectual property laws.

Except as expressly permitted, you may not copy, reproduce, distribute, modify, publish, publicly perform, create derivative works from, sell, sublicense, or exploit MindPave content without prior written permission.

7. Limited License

Subject to your compliance with these Terms, MindPave grants you a limited, non-exclusive, non-transferable, revocable license to access and use the service for your personal or internal business learning purposes.

8. Prohibited Conduct

You agree not to:

• Use the service for unlawful, fraudulent, or abusive purposes
• Share, resell, or redistribute paid course access without authorization
• Attempt to copy, scrape, reverse engineer, or interfere with the platform
• Upload or transmit harmful code, malware, or disruptive material
• Misrepresent your identity or impersonate another person
• Use the service in a way that could damage, disable, or overburden MindPave

9. User Content and Feedback

If you submit feedback, suggestions, or other content to MindPave, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, adapt, and improve that feedback or content for operating and improving the service, subject to our Privacy Policy.

10. Third-Party Services

MindPave may rely on third-party providers for hosting, payment processing, authentication, analytics, communications, and other services. We are not responsible for the independent terms, policies, or practices of third-party services.

11. Service Availability and Changes

We may update, modify, suspend, or discontinue any part of MindPave at any time, with or without notice. We do not guarantee that the service will always be available, uninterrupted, or error-free.

12. Disclaimer of Warranties

MindPave is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

13. Limitation of Liability

To the fullest extent permitted by law, MindPave and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, revenues, goodwill, or business opportunities arising out of or related to your use of the service.

To the fullest extent permitted by law, MindPave's total liability for any claim arising out of or relating to the service will not exceed the amount you paid to MindPave in the 12 months preceding the event giving rise to the claim, or $100 if you have not made any payments, whichever is greater.

14. Indemnification

You agree to defend, indemnify, and hold harmless MindPave and its affiliates, officers, employees, contractors, licensors, and service providers from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your misuse of the service, your violation of these Terms, or your violation of any law or rights of a third party.

15. Termination

We may suspend or terminate your access to MindPave at any time if we believe you violated these Terms, created risk for the platform or other users, or if required by law.

16. Governing Law

These Terms are governed by the laws of the State of Iowa, without regard to conflict of law principles, unless applicable law requires otherwise.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of MindPave after updated Terms become effective constitutes acceptance of the revised Terms.
